Bank Levy

When you owe money to the IRS in back taxes, one of the tools they have at their disposal is the bank levy - the ability to freeze money in your bank account and remove it after a waiting period. Certified Tax Group has attorneys who are experts in working through the complicated process of getting a bank levy released, and negotiating a settlement agreement on your behalf. If you're facing a bank levy, it's good to know how it works, and what can be done about it.

A bank levy is a seizure of funds in your bank account by the IRS to satisfy a tax debt. The IRS usually makes an effort to settle the debt with you first, by writing letters or sending a revenue officer to your home or work to discuss your options. The process generally works as follows: First, the IRS determines that you owe back taxes, and writes you a letter called a "Notice and Demand for Payment". At this stage, if you receive the letter or not, the IRS assumes that you are aware that you owe the government money, and that the government is attempting to collect.

The next step is you neglecting to or refusing to pay the tax. Again, you may have missed the notification, but perhaps you received and understood the notice, but chose to do nothing about it. After that, the IRS sends another letter, the "Final Notice of Intent to Levy and Notice of Your Right to A Hearing". This is the notice that your bank levy could begin in as few as 30 days. This notice could be mailed, or delivered in person to your home or work.

At this point, you can attempt to negotiate with the IRS manager assigned your case, or request a hearing. After you attend a hearing, you'll get a ruling. If that ruling is not in your favor, you can appeal, but more likely than not, the IRS will enact a bank levy. If you haven't called us to help you by now, you need to call Certified Tax Group today at 1-800-795-4029.

Once the bank levy is put in place, you have 21 days to negotiate a settlement with the IRS. This is a complicated and long process - and one that Certified Tax Group specializes in. We handle many of these cases every year. We can, in most cases, negotiate a settlement with the IRS to have your bank levy removed, and institute a payment plan for you to reimburse the government.

The key reason to work with a law firm on settling your bank levy is because of your status with the IRS. Once they place a bank levy on your account, you are classified (right or wrong) as being uncooperative. By working with professionals with Certified Tax Group, you are signaling to the IRS that you are willing to take concrete steps to resolve your debts. Call us at 1-800-795-4029 today to see how we can help you resolve your bank levy.
